OBLIGATION OF BIDDER

At the time of auction's closing, each bidder will be presumed to have read and to be thoroughly familiar with any and all plans, contract documents and documents attached to the auction listing, including but not limited to Swift County Online Land Sales: Standard Disclaimer and Swift County Terms and Conditions.  The failure or omission of any bidder to examine any form, instrument or document shall in no way relieve any bidder from any obligation in respect to their bid.  A winning bid by a qualified buyer constitutes a legally binding contract.

     Legal: LOT 12, BLOCK 2 BEGINNING AT A POINT OF THE NORTH LINE OF MAIN AVENUE IN THE VILLAGE OF MURDOCK, WHICH POINT IS 25 FEET WESTERLY FO THE SOUTHWEST CORNER OF LOT 7 IN SAID BLOCK 2, OF BRESNAHAN'S ADDITION, RUNNING NORTHEASTERLY ON A LINE PARALLEL TO THE WEST LINE OF SAID LOT 7, A DISTANCE OF 120 FEET; THENCE NORTHWESTERLY AND AT RIGHT ANGLES TO THE LAST DESCRIBED LINE, A DISTANCE OF 75 FEET; THENCE SOUTHWESTERLY AND PARALLEL TO THE WEST LINE OF SAID LOT 7, A DISTANCE OF 120 FEET TO THE NORTH LINE OF SAID MAIN AVENUE, IN THE VILLLAGE OF MURDOCK; THENCE SOUTHEASTERLY ALONG SAID NORTH LINE OF SAID MAIN AVENUE, A DISTANCE OF 75 FEET TO THE POINT OF BEGINNING.

PAYMENT TERMS – AMOUNT(S) DUE UPON SALE

Full Payment: 

Full payment of the total sale value.  

State Assurance Fee:

3% of total sale price of land and structures. This percentage is state mandated and goes into the State’s General Fund to cover losses in the event that the state has to defend its right to forfeit land.

Assessments:

If listed on sale listing as certified, assessments must be paid in full at the time of sale.  Check with the city or township clerk and county for any additional assessments that existed prior to forfeiture, which may be re-assessed by the municipality.  

Recording Fee:

$46.00 or as set by the Swift County Recorder.  If there is a well on the property, it is an additional $50.00 for well disclosure.

Deed Fee: 

$25.00

Deed Tax: 

0.0033 multiplied by the purchase price or $1.65 minimum, whichever is greater.

Torrens Property:

Purchaser will need a Proceedings Subsequent (court proceeding) completed to have the new owner’s name on the Certificate of Title.  Also, there is a fee for an Examiner’s Directive to memorialize the new purchase.

 

*DO NOT PAY FROM THE PUBLIC SURPLUS WINNING NOTIFICATION.  SWIFT COUNTY AUDITOR WILL CALCULATE AND EMAIL THE WINNING BIDDER A NOTICE OF AWARD INCLUDING THE FINAL AMOUNT DUE.

 

PAYMENT REQUIREMENTS

Payment in full in the form of Cash, Cashier's Check or Money Order made payable to the Swift County Auditor.  

Previous Default:  Payment must be made by certified funds if purchaser has ever made payment that has been returned non-sufficient funds (NSF).

 

When the auction closes, Swift County Auditor will send the winning bidder an email to begin processing the transaction.  Your prompt response is appreciated to complete the transaction in a timely manner to avoid having your bid considered null and void.

 

The successful bidder will be required to remit payment in full to Swift County Auditor within ten (10) business days from the date of this Notice of Award.  If payment in full is not received within the required time frame, Swift County reserves the right to sell the property to the next highest bidder or repost the auction.

 

CONFLICT OF INTEREST

Swift County officials and employees are prohibited from using privileged government data obtained through their position to further their own private interests.

Per Minnesota Statute 282.016, the direct or indirect purchase of tax forfeited land by individuals employed with the department of the Swift County Auditor, Swift County Treasurer and the department of the Swift County Assessor, or the Swift County Court Administrator of the District Court, or the Swift County Board of Commissioners, or the Swift County Administrator or the Swift County Attorney is prohibited.

Any person or entity, or entity controlled by such person, is a prohibited purchaser or bidder, if said person or entity is delinquent on real or personal property taxes in Swift County per Minnesota Statue 282.016.

Swift County is not responsible for any omissions or errors in the description of items being offered for sale. Under no circumstances will a refund/adjustment be made due to the property failing to meet buyer's expectations.

To the fullest extent permitted by law, Bidder shall indemnify and hold Swift County harmless from and against any claims, damages, losses and expenses, demand or cause of action arising/alleged to have arisen out of the sale or failure to sell any property including claims of personal or bodily injury, death, or contract damages.

Swift County reserves the right to accept or reject any/all auction's bids or any part of an auction's bid.
